Article II. UTILITY POLE RELOCATION FOR ROAD IMPROVEMENTS |
§ 162-38. Charges to Fulton County.
The utility company shall immediately issue orders for the relocation of all poles affected, but shall charge Fulton County only with the cost of relocating poles which exist outside the limits of the original county right-of-way, and protected by recorded easements in the name of the utility company. In locations where the county right-of-way or road easement is not clearly defined, the right-of-way shall be recognized as extending to points on either side of the roadway three feet beyond the top of the bank or foot of the slope, whichever the case may be, and the relocation of the poles within these limits shall not be paid for by Fulton County.
