§ 154-407. Death while in active service.

  • Whenever any member participating in the provisions of this division shall die while in active service and having not less than ten years of active service prior to his or her death, his widow, or her widower, provided he or she has been designated as beneficiary and has been married to him or her for at least one year prior to his or her death, shall be entitled to receive a pension during his or her life until his or her remarriage representing three-quarters of the amount that the member of the pension fund would have been entitled to receive had he or she not died but had become as of the date of his or her death totally and permanently disabled within the provisions of this division from accident, injuries, or illness outside of official duties and not from his or her own indiscretion.
