§ 154-377. Previous service with Fulton County; credit for temporary and C.E.T.A. service.
(a)
Previous service. Creditable service shall include all service rendered by a participant to Fulton County prior to the effective date of this division, provided that such participant shall have been a member of a pension fund maintained by Fulton County during such period of service and shall have paid or shall pay the maximum employee contribution which was required by law to be paid by participants in the pension fund in which such individual participated. To receive credit for such service, a participant shall in writing renounce all benefits under any other pension plan maintained by Fulton County, and shall authorize the transfer of contributions made to a previous pension plan to the pension fund created by this division. In the event that such participant shall have withdrawn his pension contributions, or in the event that such participant shall fail to have paid the full amount required by this section, then such participant shall pay directly to the pension fund the entire amount required by this section, together with interest from the end of the calendar year in which such pension contributions were withdrawn or in which such contributions were not paid. Any individual who shall be employed by Fulton County on the effective date of this division must comply with the provisions of section 154-397 in order to receive credit for prior service with Fulton County.
(b)
Credit for temporary service and C.E.T.A. service with Fulton County. Notwithstanding any other provision of this division, an individual shall be entitled to claim credit for temporary service and C.E.T.A. service with Fulton County as creditable service under this division under the following terms and conditions:
(1)
Such service must have been for full-time, continuous employment by Fulton County.
(2)
Such service must have immediately preceded and led into permanent employment by Fulton County and participation under the terms of this division.
(3)
The person claiming such service shall pay the same employee contribution which such person would have paid had he been participating in the pension fund established by this division during such period of temporary service with the same compensation as he was receiving at the time of claiming such credit. Such sum shall be matched by Fulton County.
(4)
In the event that the sums paid under subsection (b)(3) of this section shall not be sufficient to fund the actuarial liability created by the allowance of the credit authorized by this section, any additional sums which may be necessary shall be paid by Fulton County from general funds.
