Employees of Fulton County on the payroll of the county prior to the effective date
of this division shall not be required to participate in the pension fund created
hereby. However, such employees may participate if they file a written election to
participate in this fund, renouncing all other benefits under any other pension plan
maintained by Fulton County and authorize the transfer to the fund created hereby
of all contributions to the credit of such participant in any other pension fund maintained
by Fulton County. In the event that such participant shall not have paid the maximum
employee contribution required by law to be paid by participants in the pension funds
in which such an individual previously participated or, in the event that such individual
shall have withdrawn all or any part of such contribution, then such participant shall
pay to the fund created by this division, the total amount which he would have contributed,
less such amount as may be transferred by the pension fund in which he previously
participated. Upon such authorization or payment, such participant shall be entitled
to credit sole service for all years of service with which he was credited in the
previous pension plan. In addition thereto, if the election of such participant is
filed within six months following the effective date of this division, such participant
shall be entitled to receive credit for all years of creditable service with Fulton
County and years of service for employment by Fulton County or municipalities located,
in whole or in part, in Fulton County, or public agencies required by law to be supported
from funds of Fulton County, active service in the United States armed forces, and
for service in the General Assembly of Georgia, a year of such service counting for
the purposes of this resolution as a year of service in Fulton County, provided that
such person shall have made the contributions required by section 1 of the act approved
March 30, 1971, 1971 Ga. Laws, page 2309, as amended; provided, however, that no person
shall receive more than ten years' prior service credit for service rendered to any
employer other than Fulton County, plus actual military service not to exceed four
years. In the event that such election to participate is filed prior to the effective
date of this division, it shall be filed with the Executive Secretary of the Fulton
County General Employees' Pension Board. In the event it is filed subsequent to the
effective date of this division, it shall be filed with the executive secretary of
the pension board created by this division.
