§ 154-343. Refunds.
Should any person participating in the pension plan established by this division die, resign or be dismissed from the county service of the county without having received or becoming eligible to receive a pension of any kind and without having a qualified beneficiary entitled to a pension to be paid from the pension fund, such person or his estate shall be entitled to a refund of all of the person's contributions made pursuant to this division. Any participant may file a written designation with the executive secretary of the pension board specifying any person whether related to him or not, who shall be entitled to receive a refund of the contribution made by him in the event of his death. In the event this privilege is exercised by participant, then such refund shall be made to the person so designated and not to his personal representative. In the event that any participant in the pension plan established by this division shall commence to receive pension benefits and shall die or cease to be eligible for such pension benefits or his or her beneficiary shall cease to be eligible for such pension benefits and the total amount paid in pension benefits to such individual and his beneficiaries shall not equal the amount of contributions made by such individual to the pension fund established hereby, then the excess over the amount paid to such individual shall be refunded to the person or representative of such contributor or his designee as specified in this section. In the event that any person shall receive a refund of contributions, such person shall not be able to claim the period of time for which such refund was made unless he shall repay such refund in full, plus interest thereon from the date of refund.
