§ 10-387. Authority.

  • The authority of such justices of the peace emeritus shall be limited to the following:

    (1)

    To officiate at and perform marriage upon duly authorized marriage license,

    (2)

    To administer oaths,

    (3)

    To attest the execution of written documents,

    (4)

    To issue warrants returnable to the proper courts,

    (5)

    To render advice and counsel to any justice of the peace or notary public ex-officio justice of the peace in the county wherein such justice of the peace emeritus was commissioned as a justice of the peace or notary public ex-officio justice of the peace,

    (6)

    To serve as justices of the peace or notary public ex-officio justice of the peace in any militia district in the county wherein such justice of the peace emeritus has been commissioned as a justice of the peace or notary public ex-officio justice of the peace when directed by the governor to do so,

    (7)

    To have and use a seal,

    (8)

    To certify acts performed by him,

    (9)

    To certify all papers, certificates and documents issued by him as authorized in this section, and

    (10)

    To charge fees for the performance of any duty or act authorized by this section in the same amount as are provided by law for justices of the peace and notaries public of this state.
