§ 76-51. Term and rates.

  • The term for which each franchise is granted as provided herein shall be for a period of 15 years. A grantee may file an application for a renewal of a franchise at the end of the initial 15-year term and at the end of any subsequent renewal of the franchise as provided herein. A grantee shall not be required to submit a $10,000.00 filing fee with its application for renewal of a franchise. Upon receiving an application for renewal, the board of commissioners shall consider a grantee's legal, technical, character, financial, and public interest qualities in light of the grantee's past performance under its franchise. The application for renewal shall be granted by the county if the county determines that the grantee is satisfying the obligations imposed upon it by the terms and conditions of this article and is otherwise in compliance with all applicable rules and regulations of the Federal Communications Commission. The renewal shall be for an additional ten-year period.
