§ 26-474. Use of tree funds.

  • The tree fund portion of each contract referred to in section 26-473 shall be placed into one or more trust funds to be established and administered by the county finance department. Tree funds shall be equally allocated to each commission district. Such funds shall be used to plant, install, and/or maintain trees and other landscaping (including labor, permitting and/or other associated expenses) on the site of a capital project or at other public places in the commission district, including:

    (1)

    All county, publicly owned and maintained properties (public rights-of-way, medians, sidewalks, buildings, real properties, facilities, major collector and arterial roads, etc.);

    (2)

    Conservation areas dedicated to and maintained by the county;

    (3)

    Greenspace areas owned and maintained by the county.

    No tree funds shall be expended, and no trees shall be planted, with respect to property owned by a governmental entity other than the county unless and until an intergovernmental agreement between the county and said other governmental entity has been duly approved and executed by the governing bodies of both governments.
