§ 154-402. Eligibility to participate.

  • All persons employed by Fulton County as a policeman or a fireman shall be eligible to participate in the public safety employees' pension fund, provided, that such persons shall not have waived, in writing, the right to participate in pension funds maintained in whole or in part with funds of Fulton County. No person who is a participant in the public safety employees' pension fund shall participate in any other county pension fund. No employee of Fulton County, other than policemen and firemen, shall participate in the public safety employees' pension fund. No elected official of Fulton County shall be entitled to participate in the public safety employees' pension fund. Any person eligible to participate in the public safety employees' pension fund shall affirmatively elect to so participate within 60 days of his employment, or within 60 days after December 14, 1977, whichever date shall be later. Whenever any person who has been a member of any other pension fund maintained by Fulton County shall become a member of the public safety employees' pension fund all amounts contributed by that person to the other pension fund, together with employer matching funds, shall be transferred to the public safety employees' pension fund. Any obligations undertaken by that person to pay for prior service shall be payable to the public safety employees' pension fund.
