§ 154-338. Early retirement benefits.

  • All persons who shall participate under this plan may, as a matter of right, retire from active service and receive an early retirement benefit, provided such person shall have served 15 years in the active service of such county. Such early retirement benefit shall be a pension equal to a normal monthly pension benefit less one-half of one percent per month for each month not to exceed 60 months that the officer or employee lacks in being 60 years of age, and one-quarter of one percent per month of each month in excess of 60 months that the officer or employee lacks in being 60 years of age, provided that no person shall be entitled to retire under the provisions of this section unless the pension benefit computed hereunder, less the penalties provided for, shall equal or exceed any minimum pension benefit which would be required to be paid to such person under other provisions of law; provided, however, as to any officer or employee coming under the terms of this division who was in the employment of Fulton County prior to the effective date of this division, such officer or employee may elect a monthly pension benefit, hereinafter referred to as "reduced monthly pension benefit," provided that such person shall have served 25 years and shall have attained the age of 55 years. Said reduced monthly pension benefit shall be equal to a normal pension benefit, less 1/12 of two percent per month for each month the officer or employee lacks in being 60 years of age.
