§ 154-296. Establishment of pension board.

  • (a)

    There is hereby created an employee pension board for Fulton County to be composed of seven members, two of whom shall be members of the Board of Commissioners of Fulton County, two of whom shall be employees of Fulton County and participants in the fund created by this resolution, and one of whom shall be a member of the public, and the County Manager and the Director of Finance of Fulton County.

    (b)

    The members of the pension board who are members of the board of commissioners shall be appointed annually upon recommendation by the chairman of the board of commissioners at its regular January meeting in each year and shall serve for a term of one year, or until their successors are appointed and qualified; provided, however, that the original commissioner members of the board of trustees shall be appointed by the board of commissioners as of the effective date of this division and shall serve for a term ending at the next regular January meeting of the board of commissioners, or until their successors are elected and qualified.

    (c)

    The participant members of the pension board shall be elected by contributing participants to the pension fund for a term of two years, commencing on July 1, and until their successors are elected and qualified. Elections shall be conducted at such time and place as may be provided by the rules of the pension board. A majority vote of contributing participants shall be necessary to elect a member. Vacancies on the pension board shall be filled by a special election to be called by the pension board at its next regular meeting following the occurrence of such a vacancy; provided, however, that the initial participant members of the pension board shall be elected at such time and place as may be prescribed by resolution of the Board of Commissioners of Fulton County. Such participant representatives shall take office upon the effective date of this division, and one shall be elected and serve for a term ending on June 30, 1983. The other shall be elected for and shall serve a term ending on June 30, 1984. Successors to such representatives shall be elected for terms of two years, commencing on July 1, as provided in this subsection. The public members of the pension board shall be a citizen and taxpayer of Fulton County and not a public employee or holder of any public office, provided that such public member may be the same individual who serves on the Fulton County General Employees' Pension Board. Such public member shall be elected by the other members of the pension board for a term ending June 30, 1984. His successor shall be elected for a two-year term biannually thereafter. Each such public representative shall hold office until their successor is elected and qualified.

    (d)

    The pension board shall elect its own chairman and vice-chairman and shall hold at least one public meeting during each month at the courthouse or the county administration building. Correct minutes of all proceedings of said board shall be kept, and a certified copy, duly authenticated by the secretary of the board, shall be admissible in evidence in any court in this state. The commissioner members and the participant members shall be members of the pension fund created hereby. All members and officers of the pension board created by this division shall serve without pay. Each member of said pension board, before entering upon his or her duty as a member of said board, shall take an oath to faithfully execute all duties as a member of said pension board, which oath shall be in writing and recorded in the minutes of said board.

    (e)

    The Director of Finance of Fulton County shall serve as ex-officio treasurer of the pension board and as custodian of the pension fund created by this division. Said director shall handle and disburse all funds in control of the pension board.
