§ 154-185. Providing information; certifications.

  • The employer shall provide (or, if requested, certify) to the board of trustees the relevant facts concerning employees, their compensation and periods of employment and such other information as may be requested by the board of trustees to perform its duties under the plan and trust. Any such providing or certification of the information required or permitted to be provided or certified to the board of trustees pursuant to the plan and trust shall, for all purposes of the plan and trust, be binding on all interested parties; provided, however, that whenever it is proved to the satisfaction of the board of trustees that an individual's compensation, period of employment, date of birth or other fact concerning him, as so certified, is incorrect, the board of trustees may direct that the employer correct such certification, unless the individual is deemed to be estopped, and that the benefits affected by such incorrect certification be fairly and equitably adjusted to the extent necessary to take such error into account. Such error will be corrected to the extent feasible to do so in the year such error is discovered.
