§ 154-140. Reemployment of participant.

  • (a)

    Suspension of benefits. If a participant receiving benefits under the plan is reemployed by the employer, any benefits payable to him under the plan shall be suspended during such period of reemployment but shall resume as of the first day of the month following the participant's subsequent termination.

    (b)

    Effect on amount of benefits. A participant who is reemployed by the employer and becomes an active participant shall accrue benefits under the plan and trust just as any other active participant and shall be paid any such benefits to which he or she may become entitled under this subdivision upon reemployment; provided, however, that the determination of the amount of such individual's accrued benefit at such time shall take into account only those additional years of creditable service that were not used in determining any benefit whose payment is suspended pursuant to subsection (a) of this section or any benefit as to which the entire present value was distributed to the participant.

    (c)

    Reemployment. Notwithstanding the provisions of this section, an individual receiving benefits under the plan who is reemployed by the employer on a temporary basis not exceeding a period of six months in any calendar year and is ineligible to participate in the plan under the provisions of subsection (2) of the definition of eligible employee in section 154-91 shall continue to receive the pension benefit previously awarded to him, but shall not accrue additional benefits under the plan by virtue of such temporary employment. The compensation payable to such individual shall be adjusted because of the pension benefit being received.
