§ 154-74. Pension benefits due elected county officials and certain department heads.

  • (a)

    All elected officials whose compensation is paid, in whole or in part, by the Director of Finance of Fulton County and the department heads specified in subsection (b) of this section shall be entitled to the pension benefits calculated in accordance with section 4.1 and 4.2 of the Fulton County Employee Pension Resolution upon their retirement from active county employment; provided, however, that such elected officials or department heads shall retire with the creditable service specified in and under the circumstances described in section 4.1(d) of the Fulton County Employee Pension Resolution.

    (b)

    In addition to persons elected by the people, the following department heads shall be entitled to the benefits specified in subsection (a) of this section:

    (1)

    Airport director;

    (2)

    Director, office of community services and job training;

    (3)

    Clerk to commission;

    (4)

    County manager;

    (5)

    Director of data processing;

    (6)

    Finance director;

    (7)

    Fire chief;

    (8)

    Director of grounds;

    (9)

    Health commissioner;

    (10)

    Director of inspections and permits;

    (11)

    Juvenile court judge;

    (12)

    Land agent;

    (13)

    County attorney;

    (14)

    Library director;

    (15)

    Marshal (incumbent at the time of the adoption of this division only);

    (16)

    Medical examiner;

    (17)

    Director of parks and recreation;

    (18)

    Personnel director;

    (19)

    Director of planning and economic development;

    (20)

    Police chief;

    (21)

    Director of public buildings;

    (22)

    Public defender;

    (23)

    Director of public information;

    (24)

    Director of public works;

    (25)

    Purchasing agent;

    (26)

    Elections supervisor;

    (27)

    State court clerk;

    (28)

    Superior court administrator;

    (29)

    Tax assessor;

    (30)

    Tax commissioner; and

    (31)

    Zoning director.

    (c)

    All sums needed to fund any actuarial deficit created by the foregoing provisions of this section shall be paid from general county funds to the pension fund from which any of the above individuals receives pension payments.

    (d)

    All elected officials whose compensation is paid in whole or in part by the Director of Finance of Fulton County and all department heads specified in subsection (e) of this resolution, who participate in the Fulton County Employees' Retirement Systems as established by a resolution of this board on September 11, 1991, as restated in December of 1991, shall have their pension benefits computed as a department head under the provisions of section 1.20 and section 1.24 of the afore-mentioned 1991 resolution. Provided, however, that no individual affected hereby shall have their pension computed in such a way as to produce a smaller pension benefit than he/she would have been entitled to received had the afore-mentioned 1991 pension resolution not been enacted.

    (e)

    In addition to persons elected by the people, the following department heads shall be entitled to the benefits specified in subsection (a) hereof:

    (1)

    Arts and culture, director;

    (2)

    Chief clerk of state court/state court administrator;

    (3)

    Clerk to the commission;

    (4)

    Commission chairman, chief of staff;

    (5)

    Contract compliance, director;

    (6)

    County attorney;

    (7)

    County manager;

    (8)

    County manager, deputy;

    (9)

    Director of emergency communications;

    (10)

    Environment and community development, director;

    (11)

    Family and children services, administrator;

    (12)

    Finance, director;

    (13)

    Fire chief;

    (14)

    Health and wellness, director;

    (15)

    Human services, director;

    (16)

    Information and public affairs, director;

    (17)

    Information technology, director;

    (18)

    Juvenile court administrator/clerk of the court;

    (19)

    Library systems, director;

    (20)

    Marshal;

    (21)

    Medical examiner;

    (22)

    Mental health/mental retardation/substance abuse, director;

    (23)

    Parks and recreation, director;

    (24)

    Personnel, director;

    (25)

    Police chief;

    (26)

    Public buildings and grounds, director;

    (27)

    Public defender;

    (28)

    Public works, director;

    (29)

    Purchasing and land, director;

    (30)

    Registration and elections, director;

    (31)

    State court manager;

    (32)

    Superior court administrator;

    (33)

    Supply, maintenance and transportation, director;

    (34)

    Tax commissioner;

    (35)

    The heads of such other county departments of county government which may be created by action of the board of commissioners upon recommendation of the county manager.

    (f)

    All sums needed to fund any actuarial deficit created by the foregoing provision shall be paid from general county funds to the pension fund.
