§ 154-71. Public safety employees pension fund abolished; transfer of assets to employee retirement system; participant rights.

  • (a)

    The Fulton County Public Safety Employees Pension Fund created by a resolution adopted February 14, 1977, as amended, and the board of trustees heretofore existing thereunder are hereby abolished. All assets and liabilities of said fund, including the liability to make future pension payments and other benefits, are hereby transferred to the Fulton County Employees Retirement System. The Board of trustees of the Fulton County Employees Retirement System shall perform all functions heretofore performed by the board of trustees of the Fulton County Public Safety Pension Board.

    (b)

    The provisions of this section shall not affect any heretofore existing rights of any participant in the aforementioned pension fund or the beneficiary of any such participant. Any active participant may continue to make the contributions heretofore required by law and continue to accrue benefits by reason thereof; provided, however, that any such individual may elect to participate in the provisions of the Fulton County Employees Retirement System.
