Chapter 146. LAW ENFORCEMENT |
Article I. IN GENERAL |
§ 146-1. Policies governing use of force.
(a)
The board of commissioners does hereby state, clarify, and reiterate the policies governing the use of force by peace officers employed by Fulton County as follows:
(1)
In effectuating an arrest, peace officers shall only use such force as is reasonably necessary to effectuate the arrest.
(2)
Peace officers shall only threaten or use force against another when, and to the extent, that he or she reasonably believes that such threat or force is necessary to defend himself, herself, or a third person against such others' eminent use of unlawful force.
(3)
Peace officers shall only be justified in using force which is intended or likely to cause death or great bodily harm if he or she reasonably believes that such force is necessary to prevent death or great bodily injury to himself, herself, or a third person, or to prevent the commission of a forcible felony.
(4)
All peace officers shall be required to submit a written report of any use of force to their respective chief, sheriff, or marshal.
(b)
The law enforcement agencies under the jurisdiction of the Board of Commissioners of Fulton County shall continue to ensure, through training and monitoring, that peace officers comply with the above-stated policies of subsection (a) of this section.
