§ 62-74. Condemnation of real estate.

  • Power and authority is vested in said board of commissioners to condemn lands, leases and all other interests in real estate, whereby possession and title to land or as much thereof as may be necessary, may be procured by said county for the construction of said improvements, and to whatever extent it may be deemed necessary and proper within the discretion of the board. In case of any of the improvements herein specified being built or laid over or through private property, if the owner of such property claim damages for the occupation of said lands by such improvements and construction thereon, and give notice of such claim, then assessors shall be appointed to assess damage for said land by reason or on account of the construction of any such improvement upon the same, said assessors to be appointed, notice given, hearings had, and their award made, and all proceedings conducted as in case of condemnation of property for public purposes under the laws of this state.
