§ 10-353. Part-time magistrates.

  • (a)

    Part-time magistrates shall be compensated on an hourly basis at a base amount that is not less than $50.00 per hour for each hour worked as certified by the chief magistrate to the governing authority; provided however that each part-time magistrate shall receive the minimum monthly salary of not less than $592.58, which salary shall be paid without regard to the number of hours worked and shall be credited against any amount due to such part-time magistrate for hours actually worked. The minimum hourly rate may be applied retroactively to hours certified by the chief magistrate to the governing authority since January 1, 2016, subject to the availability of appropriated funds.

    (b)

    For purposes of compensation, part-time magistrates may be treated as vendors or part-time, temporary employees. If treated as part-time, temporary employees, such part-time magistrates shall be exempt from over-time pay, shall not be entitled to or participate in any benefits, including any retirement plan, nor shall they be entitled to receive paid holidays, sick leave, or other leave.
