§ 10-276. Filing of suits or proceedings; security deposits.

  • Each person filing a suit or proceeding of any character shall deposit with the clerk of said court at the time of filing or commencing such proceeding the total cost of such proceedings as prescribed in section 10-193 of this article; provided, however, that such aforesaid deposit shall not be required of any person who shall subscribe an affidavit to the effect that from poverty he is unable to pay the same. The aforesaid deposit shall be a security deposit to ensure the payment of the court cost of such proceedings. If the court cost is recovered from the losing party, the aforesaid deposit shall be refunded to the party making the deposit. And, upon the tenth day of each succeeding month, the Board of Commissioners of Fulton County shall pay over to the publisher of the newspaper which publishes legal notices for the Sheriff of Fulton County a publication subsidy in the sum of $450.00 per week for each week in which the said newspaper publishes the calendar of the said court during the preceding month as compensation for the printing and publication of the said calendars.
