§ 82-255. Inter-basin transfers in north Fulton County.

  • (a)

    Notwithstanding any other provision of this article, in order to preserve the low-density and rural character of the area as well as to avoid adverse impact upon Fulton County's sewage/wastewater treatment facilities;

    (1)

    No properties located within Fulton County and lying within the Etowah River basin shall be permitted to connect to the Fulton County sewerage system; and

    (2)

    No inter-basin transfers of wastewater from the Etowah River basin to any basin served by the Fulton County sewerage system shall be permitted, except as provided in subsections (b) and (c), below.

    (b)

    Property west and north of State Route 9, in north Fulton County, located between Windward Parkway and the Forsyth County line, may connect to the Fulton County sewerage system if a portion of the property fronts or abuts State Route 9 and the property is wholly located in District 2, Second Section, in one or a combination of the following land lots: 757, 758, 759, 826, 831, 898, 903, 970, 975, 1041, 1042, 1048, 1111, 1112, or 1113.

    (c)

    In addition to the above, legal lots of record as of March 1, 2006, and which are at least partially contained within the above-listed land lots, may connect to the Fulton County sewerage system.
