§ 82-109. Violations of article; misdemeanor.

  • (a)

    Any person found to be violating any provisions of this article shall be served written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.

    (b)

    Any person who intentionally violates any provision of this article or who shall continue any violation (intentional or otherwise) beyond the time limit provided for the satisfactory corrections thereof shall be guilty of a misdemeanor. Each day in which such violation shall continue shall constitute a separate offense.

    (c)

    Any person, firm, or corporation convicted of violating the provisions of this article shall be punished in the manner prescribed by law for misdemeanors, and shall further reimburse the county for any expense, loss, or damage occasioned by the county by reason of such violation.

    (d)

    A failure of the property owner to connect to the sewer collection system within the specified time shall authorize the county to discontinue water service to the premises in addition to the penalties otherwise provided for violation of this article.

    (e)

    Persons designated by the Fulton County Board of Commissioners are hereby authorized to issue citations or summonses, or both, to persons violating these regulations returnable to the State Court of Fulton County, or to any other court having the jurisdiction of a commitment court throughout the entire county, for trial.
