§ 82-34. Procedure for upgrading existing service.

In cases where the board of commissioners should, on its own motion, and without a
public petition, authorize the construction of a new water main to improve the pressure
and circulation of the system, the cost of such new main shall be assessed as otherwise
provided in this article. However, no assessment shall be levied against the owner
of any property which has previously been assessed for and who has tapped onto the
old existing water main, and collection of the assessment from any other owner shall
be deferred until application is made by the owner for connection to the new water
main. Upon making the application for connection to the new water main the assessment
shall be paid either in cash or by the deferred payment procedure provided under this
article. The assessment, although deferred under this section, shall be recorded and
shall constitute an inchoate lien against the property, to be perfected upon the filing
of the application for connection. All assessments under this section shall be paid
at the prevailing rate at the time of application.
