§ 76-33. Nonexclusive right of grantees to install system.

  • In accordance with the conditions and reservations which are hereinafter specified, the nonexclusive right may be granted to any persons, firms, or corporations which are approved for a franchise as hereinafter provided and which comply with the terms hereof, hereinafter referred to as grantees (and intending thereby to refer either singularly to any individual grantee or collectively to all grantees if there are more than one) and to grantees' successors, assigns, or designees, subject to section 76-46 hereof, to engage in the business of operating a broadband telecommunication system, commonly called a community antenna television (CATV) system, in the unincorporated areas of Fulton County, Georgia, for the purpose of providing cable television service and any aspects of expanded cable television service, if any, as the grantee may from time to time deem advisable. Where authorized under the provisions hereof, the grantee shall have the right and privilege to erect, install, construct, repair, replace, reconstruct, maintain, and retain in, on, over, under, upon, across, and along any public street, public way, and public place, now laid out or dedicated and all extensions thereof and additions thereto in the unincorporated areas of Fulton County, Georgia, any poles, wires, cable, conductors, ducts, conduit vaults, manholes, amplifiers, appliances, attachments, and other property as may be necessary and appurtenant to the broadband telecommunications system, in accordance with the laws and regulations of the United States of America, and the State of Georgia, and the resolutions and regulations of Fulton County, Georgia, commencing from and after the adoption of this article.
