§ 76-1. Satellite subscription television system.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Satellite subscription television system means services provided to subscribers for sale where the provider of the services utilizes a master antenna type system or earth dish type system designed to receive and distribute satellite television signals.

    (b)

    Business license restrictions. A business license to operate a satellite subscription television system shall only be issued to provide service to one or more multiple unit dwellings under common ownership wherein any wiring necessary to operate such system does not cross adjacent nonowned property lines and does not cross county rights-of-way in the unincorporated area of Fulton County.

    (c)

    Application of section. The provisions of this section shall not apply to any person, firm, or corporation that is franchised by the board of commissioners to own and operate a cable television system under sections 76-31—76-62 of this article.

    (d)

    Business license required. No person, firm, or corporation shall construct, operate or service a satellite subscription television system within the unincorporated area of Fulton County without first obtaining a business license to carry on said business.

    (e)

    License fee. The annual license fee shall be provided by chapter 18, article II of this Code.
