§ 6-205. License review hearing officer.

  • (a)

    There is hereby established a license review hearing officer.

    (b)

    The license review hearing officer established by this section has the following duties:

    (1)

    To hear appeals from administrative decisions by the police department recommending the denial of an application, or the suspension, revocation or non-renewal of a license granted hereunder.

    (2)

    To provide notice to the applicant or licensee of the date, time and place of the opportunity to be heard as provided under this article.

    a.

    The hearing will be no sooner than ten days from date of mailing the notice.

    b.

    The license review hearing officer will make a written recommendation to the board of commissioners within 30 days from the date of the hearing. The board of commissioners will render a decision within 45 days from the date of the license review hearing officer's recommendation. The decision of the board of commissioners is final unless appeal is made to the superior court of the county.

    c.

    The burden of proof will be on the applicant/licensee. The applicant/licensee has the right to bring witnesses to testify before the license review hearing officer.

    (c)

    The license review hearing officer will be appointed by the county manager, who may appoint up to three individuals to serve in this capacity.

    (d)

    The license review hearing officer will meet at such times as may be necessary, to be determined by such officer and the county manager.

    (e)

    Records of all proceedings will be kept and maintained in the office of the clerk to the commission.
