Article II. DISCRIMINATION IN PLACES OF PUBLIC ACCOMMODATION |
§ 38-32. Declaration of policy.
(a)
It is hereby declared that prejudice, intolerance, bigotry, discrimination, and the disorder occasioned thereby threaten the rights and proper privileges of the inhabitants of Fulton County and menace the institutions and foundations of a free democratic society.
(b)
It is hereby declared to be the policy of unincorporated Fulton County, Georgia, in the exercise of its police power for the public safety, public health, and general welfare to provide within constitutional limitations, that the accommodations, advantages, facilities, and privileges in any place of public accommodation, resort, or amusement shall not be denied to any person because of the sex, race, color, religion, creed, or national origin of such person.
(c)
Nothing in this article is intended to dictate the manner in which clubs, institutions, or membership organizations conduct their activities or select their members, except insofar as is necessary to ensure that organizations which are not distinctly private do not automatically exclude persons from consideration for membership or enjoyment of accommodations and facilities, and the advantages and privileges of membership, on account of invidious discrimination, and provided further that nothing contained in this article is intended to interfere in the activities or subject the operations of clubs, institutions, or membership organizations to scrutiny beyond what is necessary in good faith to enforce this article.
