§ 2-76. Contracts involving officers or employees.
(a)
The county shall not enter into any contract involving services or property with an officer or employee, or with a person or business in which an officer or employee has an interest. This section shall not apply in the case of:
(1)
Contracts for goods or services with an officer or employee, or member of the immediate family of an officer or employee, or a business that employs an officer or employee, or member of the immediate family of an officer or employee, where (i) the contract is competitively procured and (ii) the officer or employee does not participate in any aspect of the procurement or performance of the contract;
(2)
The designation of a bank or trust company as a depository for county funds;
(3)
The borrowing of funds from any bank or lending institution which offers the lowest available rate of interest for such loan;
(4)
Contracts for services entered into with a business which is the only available source for such goods or services; and
(5)
Contracts entered into under circumstances which constitute an emergency situation, provided that a record explaining the emergency is prepared by the county manager and submitted to the board of ethics at its next regular meeting.
(b)
No officer or employee shall participate in any contract involving the county if he or she knows or should have known that an interest in the contract is possessed by such officer or employee, one or more members of his or her immediate family, or any business, other than a public agency, in which he or she or a member of his or her immediate family serves as an officer, director, stockholder, creditor, trustee, partner, or employee.
