§ 26-318. Cooperation with the county.
(a)
It shall be the responsibility of any person, firm, company, corporation, etc., to cooperate with the county in the search for illicit connections or prohibitive activities as described in this division in order for the county to comply with the conditions of its NPDES permit.
(b)
Any person, firm, company, corporation, etc., shall answer the questions of the county and share information on business activities as they relate to this article, except those records and activities that are confidential and proprietary. If necessary, the county may obtain access to confidential and proprietary records and activities through a court order, subject to the following conditions:
(1)
The county shall have access to records and information for the purpose of examination for compliance with the conditions of this article only during normal business hours;
(2)
The county shall not have the right to make copies, excerpts, or transcripts of such records and activities without receiving prior written consent; and
(3)
The county shall not disclose or make available to third parties any such records or information obtained unless required to do so by a separate court order.
(c)
Failure to comply with the conditions of this division shall be considered a violation and subject to the penalties found in section 26-113.
