§ 18-84. Application investigation.

  • The county shall have 45 days (unless the application is suspended by the failure of the applicant to provide data, information or records as reasonably requested by the county to complete the investigation) from the receipt of a completed application to make a decision in which to grant or deny an adult entertainment establishment license. The director of finance shall make a recommendation to the board of commissioners regarding the approval or denial of the license and the board shall make the final decision after a public hearing regarding the same. In the event the board of commissioners has not granted or denied the application within 45 days (unless the application is suspended by the failure of the applicant to provide data, information pr records as reasonably requested by the county to complete the investigation), the license shall automatically issue and the applicant shall have the right to operate its adult entertainment establishment.
