§ 29.2. Penalty.

  • Where a determination is made that property is in violation of the zoning resolution, and any other codes and laws enforced by the department of environment and community development, and all reasonable efforts and means to obtain compliance have been exhausted, the director of the department of environment and community development is authorized to effect such compliance at public expense. The cost effectuating compliance shall constitute a lien upon the property and said lien shall be recorded by the director of the department of environment and community development in accordance with the laws for such.     The Magistrate Court of Fulton County and the State County of Fulton County shall each have jurisdiction to try offenses alleging violations by any person, firm, corporation, partnership, or other entity of this article. Upon conviction, any person, firm, corporation, partnership, or other entity shall be subject to a fine of $1,000.00 or imprisonment in the Fulton County Jail for not more than 60 days, or both this fine and imprisonment for each offense.
